Governo aprova comissão para regular o acesso a profissões

O Conselho de Ministros, presidido hoje pelo ministro de Estado e dos Negócios Estrangeiros, aprovou um decreto-lei que cria uma comissão interministerial para regular as condições de acesso a profissões.

Em comunicado, o Conselho de Ministros explica que o diploma, aprovado hoje na generalidade para consulta, "visa estabelecer os princípios do Sistema de Regulação de Acesso a Profissões que, por razões de interesse colectivo ou por motivos inerentes à capacidade do trabalhador, obrigam a restringir o princípio constitucional da liberdade de escolha de profissão, regulando as estruturas responsáveis pela sua preparação, acompanhamento e avaliação".

O conselho de ministros foi hoje presidido pelo ministro de Estado e dos Negócios Estrangeiros, Luís Amado, por José Sócrates se encontrar de férias, afirmou o ministro da Presidência, Pedro Silva Pereira, que não quis adiantar até quando o primeiro-ministro estará de férias.

O Governo aprovou um conjunto de medidas para a reforma da formação profissional, acordadas com "a generalidade dos parceiros sociais com assento na Comissão Permanente de Concertação Social" e que cria "um quadro mais ajustado à aplicação dos fundos estruturais de que Portugal vai beneficiar no âmbito do Quadro de Referência Estratégico Nacional (QREN 2007/2012)", destacou o ministro do Trabalho e da Solidariedade Social, Vieira da Silva.

Em conferência de imprensa após a reunião de conselho de ministros, Vieira da Silva deu o exemplo dos jornalistas ou dos pilotos de companhia aérea como exemplos de profissões cujo acesso estará condicionado a "requisitos especiais".

Vieira da Silva referiu que há "um conjunto de profissões com requisitos especiais como por exemplo a vossa profissão [jornalistas]", apontando "em particular profissões de enorme sensibilidade social e relevância para o bem-estar público e comum" como por exemplo "piloto de companhia aérea".

"Trata-se de criar um sistema organizado e independente" para regular as condições de acesso a profissões que até agora eram estabelecidas de "forma casuística", afirmou Vieira da Silva.

A salvaguarda do interesse colectivo e "razões inerentes à própria capacidade das pessoas" são os motivos apontados no diploma hoje aprovado para restringir o princípio constitucional da liberdade de escolha da profissão.

Para definir esses critérios e preparar a legislação específica, será criada uma comissão de Regulação do Acesso a Profissões que terá a "participação técnica das áreas governamentais responsáveis pelos sectores de actividade mais relevante", indica o comunicado do conselho de ministros.

O diploma indica ainda "os requisitos específicos necessários", regula o modo de verificação dos mesmos, bem como a entidade pública competente para emitir o título profissional, e a fixação de um regime transitório para profissões já regulamentadas".

So we awaited our turn in the great hall and then we heard the Council of Vocations call our name: “Equality 7-2521.” We walked to the dais, and our legs did not tremble, and we looked up at the Council. There were five members of the Council, three of the male gender and two of the female. Their hair was white and their faces were cracked as the clay of a dry river bed. They were old. They seemed older than the marble of the Temple of the World Council. They sat before us and they did not move. And we saw no breath to stir the folds of their white togas. But we knew that they were alive, for a finger of the hand of the oldest rose, pointed to us, and fell down again. This was the only thing which moved, for the lips of the oldest did not move as they said: “Street Sweeper.”

We felt the cords of our neck grow tight as our head rose higher to look upon the faces of the Council, and we were happy. We knew we had been guilty, but now we had a way to atone for it. We would accept our Life Mandate, and we would work for our brothers, gladly and willingly, and we would erase our sin against them, which they did not know, but we knew. So we were happy, and proud of ourselves and of our victory over ourselves. We raised our right arm and we spoke, and our voice was the clearest, the steadiest voice in the hall that day, and we said:

“The will of our brothers be done.”
